Digital Image License

A Digital Image License Agreement is made and effective on the date of image purchase from Helen Gilbert Photography, hereinafter referred to as the "Photographer", by the buyer, hereinafter referred to as the "Customer", upon the exchange of payment or the grant of a free download to the Customer by the Photographer.

Upon completion of a purchase the Photographer transfers certain rights pertaining to the Digital Image purchased, and the Customer licenses such rights. The completion of a purchase on the website of Helen Gilbert Photography constitutes an agreement between both the Photographer and the Customer to the terms and conditions set forth in this agreement.

The Photographer permits the Customer the non-exclusive, non-transferable right to use the image for Personal, non-commercial use. To create prints for personal use, or display the image on personal websites, blogs, social media, personal computers, and digital devices.
The Photographer permits limited, small-scale, commercial use of a purchased image solely by persons depicted within the images. Small-scale commercial use may include display on business websites, social media, and blogs, digital event calenders, and printed promotional material. Images may not be used in print or digital news or informational articles, nor submitted to or utilized by corporate entities, without express written permission of the photographer.

The license does not permit the customer to:
Resell, redistribute, or otherwise relicense the image to additional users.
Utilize the image for any immoral, illegal, or defamatory purposes.
Resample, modify, or build upon the image to create a new work of art.
Incorporate the image, in whole or in part, into logos, trademarks, or other similar work.
Submit the image to contests or imply the image was produced by anyone other than the photographer.

The Photographer warrants they hold the rightful title of this image and rights attached to this image, including copyright and the right to license. The image is free from any legal liability and third party rights. All images are property of the Photographer. The Photographer retains all ownership and copyright to the image.

Images may only be obtained through a purchase, or a free digital download granted by the photographer. Any other methods to download, screen grab, or otherwise copy and/or use images, whether directly from HelenGilbert.Com or another source, is copywrite infringement and is prohibited.
